New York City Delays Effective Date of New Debt Collection Restrictions and Requirements
July 16, 2026New York City has delayed the effective date of significant new restrictions and requirements on the collection of debts from New York City consumers. The new requirements, which were scheduled to take effect on September 1, 2026, are now scheduled to become effective on January 1, 2027.
The New York City Department of Consumer and Worker Protection (the “Department”) issued the new rules in February in a Notice of Adoption amending Title 6 of the Rules of the City of New York (the “Amended Rules”). Unlike federal and New York State debt collection provisions, the Amended Rules will apply to creditors, including financial institutions, collecting their own debts. The Department notified certain stakeholders of the delay in the effective date on July 15, 2026, stating that the postponement is intended “to provide additional time to respond to stakeholder questions and allow the regulated community to make any necessary operational changes.” The Department also advised that, in the coming weeks, it will publish a proposed amendment to the Amended Rules solely to conform the regulatory text to the new effective date and indicated that it expects to release a Frequently Asked Questions document in the coming weeks.
