Kelsey Gittler Obtained Summary Judgment Dismissing Plaintiff’s Complaint Against the Firm’s Retail Client
December 11, 2024Kelsey Gittler, an associate in the General Liability, Tort and Insurance department, obtained summary judgment dismissing plaintiff's complaint against the firm's retail client. The plaintiff alleged personal injuries caused by a slip and fall in a grocery store. Cullen and Dykman argued that the firm’s client was free from liability as a landowner who merely furnished the condition or occasion for the occurrence of the event and was not one of its causes. The Court agreed with our position and found that we made a prima facie showing of entitlement to summary judgment based on various documentary evidence submitted and prior to conducting party depositions. Accordingly, the Court issued a decision granting summary judgment dismissing all causes of action and cross-claims against the firm’s client.
