Exposing Fraud: Defense Results in Complete Dismissal

Our firm recently secured a complete dismissal of an alleged trip and fall action after uncovering a staged accident through diligent investigation and aggressive motion practice
The matter involved allegations that our client created and had notice of a defect in the sidewalk in front of their business. After carefully analyzing the claim and conducting our own investigation, however, we learned that our client was in fact the target of a fraud scheme.
Our team then pursued targeted motion practice which not only challenged the viability of the plaintiff’s allegations but also pointed to the several gaps in plaintiff’s case. This was based on various metadata discrepancies and the account of a witness who resided in the area.
As a result, Plaintiff’s counsel moved to be relieved as attorney of record. While the Court granted counsel’s application, plaintiff himself was required to personally appear in court to advise whether he intended to proceed pro-se or retain new counsel.
The plaintiff failed to appear as directed. As a result, the Court issued an order dismissing the action in its entirety.
