Ryan Spitz Successfully Obtained Summary Judgment Dismissing Plaintiff’s Complaint Against the Firm’s Client in a Premises Liability Case

Ryan Spitz, an associate in the firm’s General Liability, Tort and Insurance Defense Department, successfully obtained summary judgment dismissing plaintiff’s complaint against the firm’s client in a premises liability case. The plaintiff alleged that they slipped and fell on grapes in a store operated by defendant. The court found that the plaintiff failed to produce evidence in opposition that defendant created the alleged hazard, had actual notice of the alleged hazard, or that the grapes were on the floor for a sufficient length of time prior to the accident to permit its employees to discover and remedy the condition.
