Erin R. Frost Wins Defense Verdict in Orange County

Partner Erin R. Frost obtained an outstanding defense verdict for our retail client in a jury trial before Hon. Craig. S. Brown in Supreme Court, Orange County.  The plaintiff claimed that a substance on her shoe caused her to slip and fall after she retrieved an item from the top shelf in the seasonal aisle.  The plaintiff alleged that the slippery substance transferred from the store’s mobility scooter to her shoe.  Plaintiff also claimed that the display was defectively designed.

The plaintiff’s actions were captured on the store’s video surveillance system.  We retained an imaging sciences expert to enhance still images and conduct a frame-by-frame analysis of the video surveillance footage, which was shown to the jury by our trial technician.  The video and still images revealed that the plaintiff slipped and fell on a stuffed animal that she had knocked off the shelf.
