Cullen and Dykman Secures Summary Judgment for Retail Client in Premises Liability Case

Cullen and Dykman’s General Liability, Tort and Insurance Defense team successfully obtained summary judgment dismissing all claims against the firm’s retail client in a premises liability action. The plaintiff alleged she sustained personal injuries as a result of a “dangerous, defective, excessively sloped, and negligently constructed” ramp leading from the client’s sidewalk to the parking lot.

Cullen and Dykman demonstrated that the client owed no duty of care because the ramp was part of the shopping center’s common area, owned and maintained by the landlord. The Court agreed in dismissing the plaintiff’s claims and granting indemnity over against the Owner and awarding costs and attorney's fees.
