Cullen and Dykman Attorney Julia Merani Successfully Obtains Summary Judgment in Personal Injury Case

Cullen and Dykman attorney Julia Merani successfully obtained summary judgment dismissing the plaintiff’s complaint against the firm’s retail client in a personal injury case. The plaintiff alleged that she tripped and fell over a wheel stop located in the parking lot outside the client’s store.

Julia argued that the wheel stop was not a dangerous or defective condition, but rather was open and obvious and clearly distinguishable from the surrounding pavement. She also argued that the client did not create the alleged condition and did not have actual or constructive notice of any alleged defect.

The Court agreed, finding that the wheel stop was clearly visible, open and obvious, and not inherently dangerous. The Court further found that the client did not create or have notice of the alleged condition. As a result, the Court granted summary judgment and dismissed the plaintiff’s action in its entirety.
