Associate Ryan Spitz Wins Summary Judgment on Behalf of Supermarket Client in Slip and Fall Case

Associate Ryan Spitz successfully obtained summary judgment dismissing the plaintiff’s complaint against the firm’s Supermarket client in a premises liability lawsuit.

The plaintiff alleged that she was injured after she slipped and fell on a patch of ice as she was exiting her vehicle in the parking lot of the premises. Ryan Spitz skillfully demonstrated that our client lacked a duty of care because they are an out-of-possession tenant who did not own or control the premises or parking lot where the incident occurred, and had no responsibility for snow and ice removal where said incident occurred.

The Court agreed that the defendant therefore bore no liability for the parking lot condition or the alleged incident. As a result, the complaints against our client were dismissed in their entirety.
