Associate Ryan Spitz Secures Dismissal for Client in Slip-and-Fall Case

Associate Ryan Spitz successfully obtained summary judgment dismissing the plaintiff’s complaint against the firm’s client in a premises liability action.

The case involved an alleged slip-and-fall. In moving for summary judgment, Ryan argued that the plaintiff could not identify what caused the accident without engaging in speculation. The plaintiff's testimony did not establish that the floor was wet, slippery, or otherwise dangerous, and none of the witnesses could identify what caused the fall.

The Court agreed, finding that the plaintiff could not identify the cause of the accident without relying on speculation. The Court also rejected the plaintiff’s argument regarding the lack of surveillance footage, finding that the plaintiff had ample time to pursue the issue during discovery.

As a result, the Court granted our client’s motion for summary judgment and dismissed the complaint.
