Associate NallyAnn Scaturro Secures Motion to Dismiss in Premises Liability Case
October 16, 2026Cullen and Dykman Associate NallyAnn Scaturro successfully obtained a dismissal of the plaintiff's claims against our client in a premises liability case involving an alleged trip and fall on a sidewalk in Queens, New York. The plaintiff claimed to have sustained injuries from the incident and brought an action against multiple defendants, including our client.
Our firm argued that the plaintiff failed to serve our client with the summons and complaint within the required 120-day period following the start of a lawsuit. The Queens County Supreme Court agreed, finding that it lacked personal jurisdiction over our client and granted the motion to dismiss, removing our client from the plaintiff's direct action.
