Associate Kaitlyn McGuire Wins Summary Judgment in Personal Injury Case and Dismisses All Cross-Claims for Indemnity
May 4, 2026Kaitlyn McGuire successfully obtained summary judgment dismissing the plaintiff’s complaint against the firm’s supermarket client and was further granted summary judgment on the client’s cross-claim for contractual indemnification against the landlord.
The plaintiff alleged that she was injured after falling in the parking lot of our supermarket client. Kaitlyn skillfully demonstrated that the maintenance and upkeep of the parking lot was the responsibility of the property’s landlord and not our client.
The Court agreed that the defendant met its burden on summary judgment and that the plaintiff failed to raise a triable issue of fact in opposition. As a result, the complaint was dismissed in its entirety, and summary judgment was granted in favor of our client on its contractual indemnification claim against the landlord.
