Andria Simone Kelly Successfully Obtained Summary Judgment Dismissing Plaintiff’s Complaint Against Firm’s Retail Client in Personal Injury Case

Andria Simone Kelly, a partner in the firm’s General Liability, Tort and Insurance Defense department, successfully obtained summary judgment dismissing the Plaintiff’s Complaint against the firm’s client. The Plaintiff alleged that she was injured when a cashier at the Defendant's store bumped into her when he was bending over to reach beneath the cash register. Through a frame-by-frame analysis of the store's video surveillance system, the court found that while it is not clear whether the Plaintiff and cashier ever even made physical contact, it is apparent that no negligence occurred. The Court notes that in the instant matter, the Plaintiff did not fall down and went about the rest of her business.
