Olivia M. Gross is a partner in the firm’s Construction Litigation department. Olivia is a highly recognized authority in New York insurance coverage litigation and appellate practice.  She has developed expertise in a wide spectrum of claims defense work, including construction Labor Law claims and related risk transfer. An expert negotiator and mediator, Olivia is actively involved in premises liability, construction, and insurance coverage litigation. She lectures on premises liability, accident prevention, claims investigation, indemnification, insurance coverage and defense strategy.  For decades she was involved in municipal liability as well. She has been responsible for seminal appellate decisions including antisubrogation and horizontal exhaustion issues, and sole proximate cause as a defense to absolute liability claims.

Olivia has litigated many declaratory judgment actions in the state and federal courts and has been responsible for numerous risk transfers and indemnity recoveries in insurance litigation on behalf of our clients.  She has assisted in the negotiation of policy endorsements on behalf of insureds and recommended insurance policy language to insurer clients.
