Michael C. Manniello is a partner in the Bankruptcy and Creditors’ Rights department. He concentrates his practice on residential and commercial mortgage lending and foreclosure and enforcement of lenders' rights. In addition to representing some of the largest mortgage servicers in the United States, in foreclosure trials, Michael has frequently appeared before the Appellate Division of the Supreme Court of the State of New York. There, he has argued complex issues such as standing, usury, waiver, the effect of notice of pendency, and the statute of limitations. Favorable decisions in those matters have been cited by both the bench and the bar. Michael has successfully defended actions in federal court against lenders under the Fair Debt Collection Practices Act, and he has obtained favorable decisions in bankruptcy appeals before the United States District Court.
