Cullen and Dykman secures New Jersey Supreme Court ruling Affirming the State’s authority to Establish Pierhead Lines, Ending a Challenge to the In-Water Improvements of the Firm’s Client
March 24, 2026On March 18, 2026, the New Jersey Supreme Court issued a unanimous decision in In the Matter of P.T. Jibsail Family Limited Partnership, clarifying the scope of the New Jersey Tidelands Resource Council’s (“TRC”) authority under the Tidelands Act, N.J.S.A. 12:3-1, et seq. Cullen partner Amie Kalac successfully argued that the TRC may establish or modify the pierhead line in front of an island in connection with granting a tidelands license to an individual property owner, rather than establishing pierhead lines on a global and uniform basis. The New Jersey Department of Environmental Protection (NJDEP) agreed, and the arguments presented to the Court by the Attorney General’s office aligned with those put forth on behalf of the Firm’s client.
