Cullen and Dykman Obtains Summary Judgment for Oral Surgeons in Supreme Court, Suffolk County
April 18, 2017Cullen and Dykman recently obtained summary judgment on behalf of two Suffolk County Oral and Maxillofacial Surgeons and their practice in the defense of a complex, high-exposure dental malpractice action.
Plaintiff, a woman in her early 20’s, claimed the defendant Oral Surgeons departed from accepted standards of practice in oral and maxillofacial surgery in the performance of orthognathic surgery resulting in iatrogenic injuries to the plaintiff.
In moving for summary judgment, defendants relied upon the detailed affidavits and testimony of the defendant Oral Surgeons which clearly outlined that, contrary to plaintiff’s allegations, their care and treatment of the plaintiff was rendered in accordance with accepted standards of practice in oral and maxillofacial surgery.
Although plaintiff opposed the motion with an Expert Affidavit, the Suffolk County Supreme Court (Pastoressa, J.) granted summary judgment in favor the defendant Oral Surgeons and their practice and dismissed the plaintiff’s suit in its entirety.
