Associate Kelsey Gittler Wins Motion for Summary Judgement for New York Based Supermarket Chain
November 21, 2025Associate Kelsey Gittler has successfully obtained summary judgment on behalf of our retail client, resulting in the complete dismissal of all plaintiff claims.
The plaintiff claimed she was injured after slipping on a wet floor near the store’s exit, alleging that our client created and had notice of a dangerous condition, failed to clean it properly, and that the wet floor signs weren't visible. The Court rejected those arguments, finding that our client’s employee was actively cleaning the area to remedy a drink that was spilled by another customer, and a caution sign was clearly visible. Kelsey effectively demonstrated that the evidence showed reasonable steps were taken and that our client satisfied its duty to warn of a potentially dangerous condition by placing a warning sign in the area where plaintiff fell.
