Partner Diana Neyman Successfully Obtained Dismissal in an Alleged Rear-end Motor Vehicle Accident Case

Partner Diana Neyman obtained another exceptional victory in an alleged rear-end motor vehicle accident. Plaintiff alleged cervical, thoracic and lumbar herniations with impingement and radiculopathy as well as continuing permanent disability. Plaintiff asserted that she had suffered permanent consequential limitation of use of a body organ or member or a significant limitation of use of a body function or system and that she had been unable to perform substantially all of the material acts which constitute her usual and customary daily activities for not less than ninety days during the one hundred eighty days immediately following the date of the accident. Diana successfully refuted each of these claims and the Court granted her motion for summary judgment and dismissed Plaintiff’s complaint.
