Partner Daniel S. Eichhorn Successfully Obtained a Trial Verdict in Favor of the Firm’s Commercial Client on all of the Clients’ Claims Including Attorneys’ Fees

After the completion of a lengthy contested litigation and a four-day trial, on behalf of a medical billing service provider client of the firm, Daniel S. Eichhorn obtained a trial verdict in favor of the client on all of the clients’ claims, including its claims for compounding interest, attorneys’ fees and litigation expenses. In addition to obtaining a verdict in favor of the client’s affirmative claims, Mr. Eichhorn also obtained as part of the same verdict, the dismissal of the Defendant’s entire counterclaim.

The lawsuit involved the claims of a medical billing client against a medical practice for the medical practice’s failure to pay invoices, as well as the medical practice’s improper termination of the parties’ contract.  The Court concluded that the medical practice breached the parties’ contract by failing to pay the medical billing client’s invoices. The Court further concluded that the medical provider breached the parties’ contract by not timely providing the contractually required pre-termination notice to the medical billing client. The Court awarded damages in favor of the client in the amount of the unpaid invoices, plus the compounding interest that accrued on same. The Court additionally awarded damages in favor of the client for the remaining term of the Contract that would have existed had the termination notice been timely provided and for additional damages provided for under the Contract related to the improper and premature termination of the Contract. The Court also found that pursuant to the Contract that the medical billing client was entitled to an award of attorneys’ fees and litigation expenses.
