Cullen and Dykman Successfully Obtained Summary Judgment Dismissing the Plaintiff’s Complaint Against the Firm’s Retail Client in a Premises Liability Case

Cullen and Dykman successfully obtained summary judgment dismissing the plaintiff’s complaint against the firm's retail client in a premises liability case. The plaintiff alleged that he slipped and fell, causing him serious injuries, due to a "defective or dangerous condition through an affirmative act of negligence". Cullen and Dykman demonstrated that the Plaintiff did not know what caused him to fall, and that Plaintiff did not see a substance on the ground, nor claim any other defective condition. The Court agreed with Cullen and Dykman's argument and granted summary judgment dismissing the plaintiff's complaint.
