Cullen and Dykman Successfully Obtained Summary Judgment Dismissing the Plaintiff’s Complaint Against the Firm’s Facilities Management Client in a Personal Injury Case

Cullen and Dykman successfully obtained summary judgment dismissing the plaintiff’s complaint against the firm’s facilities management client in a personal injury case. The plaintiff had alleged she slipped and fell in the kitchen area of a hospital due to a leaky dishwasher. Cullen and Dykman argued that the client did not owe a duty to plaintiff because plaintiff was not a party to the management agreement between the client and the Hospital, nor was the agreement so comprehensive as to displace the Hospitals duty to maintain and repair the dishwasher. Cullen and Dykman also argued that client did not have notice of the leaky dishwasher and no dishwasher defects were reported.
