Cullen and Dykman LLP Wins Dismissal of Malpractice Case against Oral Surgeon in Supreme Court, Suffolk County
April 2, 2018Cullen and Dykman LLP recently obtained summary judgment on behalf of a Suffolk County Oral and Maxillofacial Surgeon and his practice in the defense of a high-exposure dental malpractice action.
Plaintiff, a woman in her late 50’s, claimed the defendant Oral Surgeon departed from accepted standards of practice in oral and maxillofacial surgery in the surgical insertion of upper jaw bicuspid implants resulting in nerve damage, facial drop and scarring.
In moving for summary judgment, defendants relied upon the detailed affidavit and testimony of the defendant Oral Surgeon which clearly outlined that, contrary to plaintiff’s allegations, the care and treatment of the plaintiff was rendered in accordance with accepted standards of practice in oral and maxillofacial surgery. Defendants also relied upon testimony elicited by defendants’ counsel from the plaintiff.
On March 23, 2018 the Suffolk County Supreme Court (Justice Berland) granted summary judgment in favor the defendant Oral Surgeon and his practice and dismissed the plaintiff’s suit in its entirety.
