Construction Group Partner Patrick M. Caruana and Associate Ian Amann-Rao Obtain Summary Judgment Dismissing Plaintiff’s Complaint Against the Firm’s Transit Clients in Bus Accident
February 26, 2026The Cullen and Dykman Construction Litigation Team secured a dismissal of a personal injury negligence action on behalf of the Firm’s transit clients in a bus accident case. Plaintiff claimed that the client’s bus negligently entered an intersection striking plaintiff’s vehicle causing plaintiff serious injuries.
Cullen and Dykman argued that objective video evidence showed that the bus entered the intersection with a green light and plaintiff was the sole proximate cause of this accident for entering the intersection against a red light. Plaintiff argued that his testimony demonstrated that his vehicle entered the intersection with a green light, and even if the bus entered the intersection with a green light it did so at an unreasonable speed.
The court agreed with our argument and the objective video evidence that the bus operator entered the intersection with a green light and did so at a reasonable speed. The court found that “plaintiff’s testimony does not create an issue of fact in light of the objective video evidence clearly establishing that plaintiff ran a red light.” Accordingly, the court granted the motion and dismissed all claims against the transit clients.
