Associate Ryan Spitz Obtains Summary Judgement on Behalf of Firm’s Retail Client
January 23, 2026Associate Ryan Spitz has successfully obtained summary judgement on behalf of the firm's retail client. The plaintiff, a former employee of the tenant retail chain, alleged injuries after being struck by fallen ceiling tiles, claiming the condition was caused by a roof leak that led to cracking and deterioration of the ceiling. The Court rejected these arguments, finding that the defendant, our client, was an out-of-possession landlord that had delegated responsibility for maintenance of the ceiling and the premises to the tenant. The Court determined that the alleged condition also did not constitute a violation of the New York City Property Maintenance Code, warranting the dismissal of the case.
