Associate Ryan Spitz Obtains Summary Judgement on Behalf of Firm’s Retail Client

Associate Ryan Spitz has successfully obtained summary judgement on behalf of the firm's retail client. The plaintiff, a former employee of the tenant retail chain, alleged injuries after being struck by fallen ceiling tiles, claiming the condition was caused by a roof leak that led to cracking and deterioration of the ceiling. The Court rejected these arguments, finding that the defendant, our client, was an out-of-possession landlord that had delegated responsibility for maintenance of the ceiling and the premises to the tenant. The Court determined that the alleged condition also did not constitute a violation of the New York City Property Maintenance Code, warranting the dismissal of the case.
