Partner Diana Neyman Successfully Obtained Defense Verdict in a Motor Vehicle Accident Jury Trial

Diana Neyman, a partner in the firm’s General, Tort, and Insurance Litigation Department, obtained an exceptional defense verdict in a rear-end collision motor vehicle accident jury trial before Hon. Robert A. McDonald in Supreme Court, Queens County.  The plaintiff claimed that while stopped at a stop sign, he was struck in the rear and was caused to sustain serious injuries including tear of the posterior horn of the medial meniscus, treated with arthroscopic surgery and bulges and herniations to the cervical and lumbar spine, treated with interlaminar lumbar epidural steroid injection and trigger point injection along with 10 months of physical therapy.

Despite this being a rear-end collision motor vehicle accident, Diana was successful in demonstrating that her client was not the sole cause of the accident, establishing that there was no stop sign at the accident location at the time of the alleged accident and plaintiff's own actions contributed to the accident. In addition, Diana was successful in establishing that plaintiff did not sustain a serious injury pursuant to the Insurance Law under any of the threshold categories, and thus, the jury returned a defense verdict for Diana's client.
