Partner Diana Neyman Successfully Obtained Defense Verdict in a Motor Vehicle Accident Jury Trial

Partner Diana Neyman obtained another exceptional defense verdict in an alleged pedestrian knock-down motor vehicle accident after a jury trial before Hon. Richard J. Montelione in Supreme Court, Kings County.  The plaintiff claimed that while walking along the sidewalk, he was struck by a vehicle reversing out of a parking lot and was caused to sustain serious injuries including bulges and herniations at every level of the lumbar spine, treated with five-level L1 through L5 fusions, laminectomies and facetectomies. Plaintiff also claimed that the surgery was not successful and left him ambulating with bilateral crutches.

Diana, with the assistance of the Cullen & Dykman General Tort Defense team in investigating and preparing this matter for trial, was successful in demonstrating that the accident did not occur as plaintiff claimed and that the client was at a full stop on the sidewalk when plaintiff approached her vehicle, claiming that she struck him, before walking away. After conclusion of the liability trial, the jury returned a defense verdict for Diana's client.
