John Cosgrove Successfully Obtained Summary Judgment Dismissing the Plaintiff’s Complaint Against the Firm’s Casino Client in a Premises Liability Case

John Cosgrove, an associate in the firm’s General Liability, Tort, and Insurance Defense Department, successfully obtained summary judgment dismissing the plaintiff’s complaint against the firm’s casino client in a premises liability case stemming from a trip and fall on a “bunched up carpet.” Cullen and Dykman, relying on an accident report, photographs of the subject accident area, and surveillance video, argued that the firm’s client did not create the alleged dangerous or defective condition, nor had actual or constructive notice of that condition for a sufficient length of time to discover and remedy it. The Court agreed with the firm’s position, finding that the alleged defective or dangerous carpet condition was latent and would not be discoverable upon a reasonable inspection.
