John Cosgrove Successfully Obtained Decision Dismissing Plaintiff’s Complaint Against the Firm’s Retail ClientDecember 15, 2021
John Cosgrove, an associate in the firm’s General, Tort, and Insurance Litigation Department, successfully obtained a decision dismissing the plaintiff’s complaint against the firm’s retail client. Upon receipt of an alleged medical malpractice action, Cullen & Dykman filed a pre-answer motion to dismiss the plaintiff’s complaint for failure to state a cause of action or, in the alternative, directing the plaintiff to provide a more definitive statement regarding his allegations. The Court agreed with the firm’s position, finding that the plaintiff’s factual allegations were insufficient to establish a claim against the firm’s retail client. The Court granted our motion and ordered the case be dismissed.
