Hayley Kelch Conducts Webinar on Non-Profit Revitalization Act

Cullen and Dykman partner Hayley M. Kelch presented a webinar to members of the Commission on Independent Colleges and Universities ("cIcu") on May 6, 2014, entitled “What You Need to Know about the Non-Profit Revitalization Act of 2013.”

The Non-Profit Revitalization Act of 2013 (the “Act”) was signed into law on December 18, 2013. The Act signifies the first substantial overhaul of the laws governing New York’s nonprofit sector in almost a half-century. It amends numerous sections of the New York Not-for-Profit Corporation Law and several sections of other New York laws, including, but not limited to, the Executive Law, Education Law, Religious Corporations Law and the Estates, Powers and Trusts Law. The purpose of the Act is two-fold: to reduce unnecessary and expensive regulatory burdens on nonprofits and to strengthen nonprofit governance and accountability. Most provisions of the Act are scheduled to take effect on July 1, 2014.

Ms. Kelch’s webinar was uniquely tailored to the interests of private colleges and universities. In addition to providing a comprehensive overview of the Act, Ms. Kelch addressed the applicability of the Act to private colleges and universities in particular and offered suggestions for bringing such organizations into compliance with the Act.
