Adrienne Yaron Successfully Obtained Summary Judgment Dismissing the Plaintiff’s Complaint Against the Firm’s Construction Client in a Labor Law Case

Adrienne Yaron, an associate in the firm’s Construction Litigation group, successfully obtained summary judgment dismissing the plaintiff’s complaint against the firm’s construction client in a Labor Law case. The case stemmed from the plaintiff, a painting foreman, being struck by a piece of sheetrock panel. Adrienne defeated plaintiff’s Labor Law claims by proving our client as a carpentry subcontractor, only responsible for the work defined with its trade, was not subject to Labor Law 240(1) and 241(6). Adrienne obtained dismissal of the negligence claims by successfully proving that our client did not cause or create the condition, had no duty to rectify it, and had no actual or constructive notice of it.
