Scott D. Greenspan is a partner in the firm's Commercial Litigation department. He represents a variety of companies in a range of industries. Scott is well-known in the New York legal community for helping to achieve the best results for his clients. Scott has litigated large cases in courts all over the country in more than 20 states. 

Scott is best known for a national victory – one of the most significant defense verdicts of the year – where he served as lead trial counsel and defended a major insurance carrier in a two-month trial, winning a defense verdict against a $100 million claim. In his best known Long Island victory, a case heavily covered in the local media, Scott served as lead counsel to the world’s largest privately-held fitness company and saved the lease and his client’s possession of its largest health club in the world – fending off a $14 million claim by the landlord on summary judgment after winning an injunction ex parte to stop the landlord from terminating the lease. Not only did Scott save the lease but he protected his client’s over $10 million investment in the health club and the jobs of over 100 of its employees. Scott now serves as national real estate litigation counsel for that client in cases all over the United States and Canada.

Scott also has a vibrant commercial litigation, business divorce, insurance coverage litigation and real estate litigation practice.  He routinely handles business divorce and other disputes between business owners.  Recently, he successfully represented minority shareholders in a “bet the company” litigation against the majority shareholders of an over $100 million chain of nursing homes, shepherding the hard-fought case to a highly favorable settlement. 

Scott also recently won a Temporary Restraining Order against accountants who walked out of a major accounting firm with client files and data to join a competitor firm.  He is currently representing one of the world’s largest cosmetics and home fragrance companies in a very large breach of contract dispute in the New York Supreme Court’s Commercial Division in Manhattan where the opposing party seeks tens of millions of dollars in claimed lost profits damages.  And he serves as the primary outside counsel to New York City’s fastest growing real estate brokerage firm.

Scott is renowned for his creativity in settling cases that other lawyers claimed were not settleable. As such, Scott believes that the best way to achieve the most favorable results for his client is to prepare every case as if it is going to trial – and to be willing to go to trial if needed.

Representative Experience

  • Served as lead trial counsel in a $100 million insurance coverage litigation, involving over 20 witnesses, and won a complete defense verdict after an over two month trial.
  • Served as lead counsel to the world’s largest privately-held fitness company and saved the lease and his client’s possession of its largest health club in the world – fending off a $14 million claim by the landlord on summary judgment after winning an injunction ex parte to stop the landlord from terminating the lease.   • Served as lead counsel to minority shareholders in a fiercely litigated battle with majority shareholders over corporate control of a large chain of nursing homes, resulting in a business divorce and settlement on terms highly favorable to the client minority shareholders.
  • Serves as lead counsel defending a major cosmetics and home fragrance manufacturer against breach of contract/defective product lawsuit seeking over $45 million in lost profits and damage to business enterprise damages.  
  • Represent sole defendant in litigation over the management of and investments by a family limited partnership valued in the tens of millions of dollars.
  • Lead insurance coverage litigation counsel to global insurance carrier, in connection with construction defect claims (worth $1 billion) and dental professional liability claims (worth $1.6 billion) from an alleged overtreatment scheme in 70 dental clinics around the country.
  • Represented insurance carrier before a California federal judge and obtained summary judgment holding that his client did not owe $20 million in defense costs to its insured.
  • Represented a manufacturer client in environmental pollution claim obtaining over $20 million in insurance settlements and hundreds of millions of dollars were recovered from the insurance carriers for asbestos, toxic tort and environmental claims.
  • Served as lead counsel to a major geotechnical engineering firm in a $40 million professional liability action arising from the largest retaining wall collapse in New York City history, ultimately achieving a very favorable settlement that saved his client’s business and the jobs of its 1,000 employees.
  • Represented a Central American restaurant franchisee in an international arbitration against the world’s largest restaurant franchisor and won a decisive victory, soundly defeating one of the top five New York City-based firms.
